1. Introduction: These Terms of Use govern your use of the Studieven platform operated by Studieven ApS (CVR: 45003965), Daniel Johnbaskar (“Studieven”, “we”), including related tools, services, content, and any associated software or materials. By accessing or using the Studieven Platform, you agree to be bound by these Terms.

2. User Responsibilities: You agree to use the platform only for lawful and educational purposes. Misuse of the platform or violation of your institution's academic policies may result in suspension or termination of your account.

3. Intellectual Property: All content on Studieven is owned by us or our partners. You may not copy, redistribute, or reverse engineer any part of the platform without permission.

4. Account Security: You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized use of your account, contact us immediately.

5. Subscriptions and Payments: We offer monthly and yearly subscriptions that auto-renew unless cancelled. Payment is processed via Stripe. All fees are non-refundable except as required by law.

6. Cancellations and Free Access: You may cancel your subscription at any time via your account settings. We also offer limited free access (currently 5 free trial uses per month, which resets monthly). We reserve the right to modify or revoke free access without notice.

7. Platform Use: You may only use the platform for your own educational purposes. You must not attempt to bypass security, share access, or use the platform in any way that could harm others or violate applicable laws.

8. Content and Ownership:
  • 8.1 Ownership. You retain all rights in any files, text, images, or other materials you upload (“User Content”). Studieven does not claim ownership in your User Content.
  • 8.2 Limited license to operate the service. You grant Studieven a limited, non-exclusive, revocable, worldwide, royalty-free, and sublicensable license to temporarily store, host, and process your User Content solely to provide the features you request (e.g., generating summaries, notes, mock exams, or flashcards). This license ends when processing is complete and our deletion flow has run.
  • 8.3 No long-term storage of uploads. We do not keep your uploaded source files longer than necessary to complete processing. After processing, we promptly delete upload copies under our control. We may retain minimal system logs strictly for security, abuse prevention, billing, or legal compliance; these logs do not contain your full uploaded materials.
  • 8.4 Temporary sharing with OpenAI as processor. To provide requested features, we send your uploads to OpenAI’s services for temporary processing. OpenAI acts as our data processor/sub-processor and uses your data only to perform your request. We configure our use so that OpenAI does not use your data to train its models. For more on how OpenAI processes and retains API data, see OpenAI’s privacy for developers.
  • 8.5 Outputs vs. inputs.Platform-generated results (e.g., notes, flashcards, mock-exam questions) are stored in your account so you can access them. Studieven does not claim copyright in the Outputs; they are for your personal study use. You are responsible for how you use them, including compliance with academic integrity rules.
  • 8.6 No sharing of your source files with others. We do not disclose or make your uploaded source files available to other users unless you explicitly choose to share (e.g., in a study group you join or create).
  • 8.7 Deletion controls. You can delete Outputs from your account at any time. Where feasible, you may request deletion of residual data associated with your account, subject to legal and security requirements.

9. Score Sharing in Group Courses: By joining a group course, you agree that your personal score/progress may be stored and shared within that group. This enables collaborative progress tracking.

10. Right of Withdrawal: If you are a consumer in the EU, you may have a 14-day cooling-off period. However, when you request immediate access to digital services, you acknowledge that the service starts right away and that the right of withdrawal may no longer apply.

11. Service Changes & Notice: We may change subscription prices or features with at least 1 month notice. We may create new subscription plans; existing subscribers can continue on their current plan until renewal or cancellation.

12. Liability: To the maximum extent permitted by law, our liability is capped at the total fees you paid in the 12 months before the claim. Nothing in these Terms limits liability for death, personal injury, or intentional misconduct.

13. Governing Law and Dispute Resolution: These Terms are governed by Danish law. Disputes should first be attempted resolved through our support team. If necessary, disputes will be settled in the City Court of Odense, Denmark.
